Terms of Play

1) The Competition (Arm Candy) is operated and promoted by Gear Digital Limited (“Gear Digital”) whose registered office address is 83 Ducie Street, Manchester, M1 2JQ. Gear Digital can be contacted by phone on 03332001632 or via email at info@arm-candy.uk Monday to Friday from 9am to 5.30pm.

2) Gear Digital will provide each Arm Candy entrant with the ‘Competition’ and the opportunity to take part in quizzes, prize drawers and other such services that Gear Digital deem appropriate.

3) The Arm Candy Competition is open to all UK residents aged 16 years or over - except for Gear Digital Limited employees, their family members or anyone Gear Digital deems to be connected with the running or operation of the competition.

4) By entering the Competition, Entrants agree:

4.1) to be legally bound by these Terms and Conditions;

4.2) that if they win a prize, their name, likeness and geographical location may be used by Gear Digital to conduct pre-arranged promotional activities and in the production of marketing materials;

4.3) that Gear Digital may send you marketing messages and future offers via SMS (text message) and / or email;

4.4) [Subject to receiving your opt in consent], selected Gear Digital partners may send you marketing messages and future offers via SMS (text message) and / or email. 

5) If you do not want to receive promotional information from Gear Digital Limited and its selected partners please send an email to info@arm-candy.uk with a subject of ‘optout marketing’ only. Any use of entrants’ personal data will be subject to the terms and conditions of the Gear Digital Privacy Policy.

6) Provided Gear Digital draws it to your attention, it reserves the right to amend these Terms and Conditions at any time. Furthermore it reserves the right to cancel, alter or amend the Competition or the Prize at any stage of its operation if it is deemed necessary in its opinion, or if circumstances arise such that it is considered a necessary action for reasons outside of its control. Following any notification of change, thereafter you agree to be bound by the amended Terms and Conditions by continuing with your competition entry.

7) Payments and Charges

7.1) The competition entry cost is determined by the volume of tickets purchased in any visit (or session). Mobile billing will add the charge to your mobile phone bill or will reduce your phone credit if you are a pre-pay customer (Pay-as-you-go). Mobile billing is a regulated payment technology approved, managed and mandated by the UK mobile networks (Vodafone, O2, EE, Three).

7.2) All monetary amounts referred to herein are payable in UK pounds sterling (£) and are inclusive of value added tax (VAT) and any other sales taxes payable within the United Kingdom.

8) Competition Rules

8.1) Full payment is required for an entry to be valid.

8.2) All entrants will select their preferred prize before entering the competition, in the form of their chosen handbag. The chosen handbag is the prize on offer to the entrant, should they win the competition.

8.3) A skill based challenge must be successfully completed in the device web browser at the time of entry. The standard challenge is to guess the number of sweets in a jar, although Gear Digital reserves the right to alter the challenge without prior notice. A guess must be registered for each ticket purchased.

8.4) A competition week runs from Monday 00:00:00 (“Opening Time”) to Sunday at 23:59:59 (the “Closing Time”). The official count will made as soon as possible after the “Closing Time” each week.

8.5) The entrant that provides either the exact number or closest guess to the official count will either be declared the winner and will be awarded their prize in the form of their chosen handbag at the point of entry. There will be only one winner in each competition week. Should the competition result in a tie between two or more entrants who have each guessed the exact number matching the official count, or have each provided the closest guess, the winner will be selected at random by the independent panel who conducted the count or invited to take part in a tie-breaker challenge. In theinstance where the competition results in two or more entrants who have guessed the exact numbermatching the official count, and a winner is then chosen, either at random by the independent panel orby the tie-break process, those that are not the “winner” will be provided a £50.00 Selfridges voucher.

8.6) Each week prize winner(s) will be contacted after the official count has taken place, and the winner(s) have been identified. Prizes must be claimed within 28 days of notification, after which the prize will be forfeited, unless deemed to be in exceptional mitigating circumstances by the Gear Digital management, as a consequence of the procurement process for such prestigious prizes.

8.7) If a prize is not claimed within the specified 28 day period, Gear Digital reserves the right to offer the prize to a runner up without exception, or to advertise the prize in a separate Gear Digital competition, not necessarily related to this Arm Candy competition. If either action is taken, irrespective of mitigation, neither the prize, nor any alternative, will be awarded to the original winner who failed to make their claim. The prize will have been forfeited.

8.8) Gear Digital reserves the right to withhold prizes at its sole discretion. Entries on behalf of another person will not be accepted and joint submissions are not allowed. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered for any technical or other reason. Entries received will only qualify for the competition period in which they were received, and cannot be considered for previous or future weeks.

8.9) All entrants are entitled to take part in the competition multiple times. For example, an entrant can select one handbag and play 10 tickets, then select another handbag and play additional tickets and so on. An entrant who plays multiple times in this manner may increase their chances of winning depending on how they determine their guesses. Only one prize will be awarded each week. If an entrant who plays multiple times for different prizes is declared the winner, they will be awarded a single prize relating to their closest guess. If the same guesses have been registered such that they have the same winning guess attributed to two (or more) selected handbags, then the winner must choose a single preferred handbag as their prize. Entrants who wish to play multiple times are encouraged to vary their guesses for all tickets across any number of plays to increase their chances of winning. For the avoidance of doubt, the number of guesses made does not by default increase the chance of winning the competition. As a game of perception and skill, a calculated guess which is varied across multiple tickets is more likely to result in a better chance of winning, if the initial calculated guess is close to the official count.

9) General

9.1) Address details are not required in order to enter the competition. Gear Digital Limited must obtain address details for winner(s). The winner(s) can either send a self-addressed envelope with full name to PO Box 5501, Manchester, M61 0PL, 0PL, Gear Digital must receive this letter within 28days following notification of the win, or provide the detail to Gear Digital Limited or via email or over the telephone.

9.2) Any promotional activity or press release the winner makes in relation to the Competition must be pre-approved by Gear Digital in writing.

9.3) Gear Digital excludes liability to the full extent permitted by law for any loss in respect of any damage or injury occurring to the entrant arising from participation in this Competition, or occurring to the winner arising from receipt and/or acceptance of their prize. We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

9.4) The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

9.5) We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

9.5.1) use of, or inability to use, our Competition service; or

9.5.2) use of or reliance on any content displayed on our site. In particular, we will not be liable for:

9.5.3) loss of profits, sales, business, or revenue;

9.5.4) business interruption;

9.5.5) loss of anticipated savings;

9.5.6) loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

9.6) These Terms and Conditions and all aspects of the Competition are subject to the laws of England and Wales and the exclusive jurisdiction of the courts of England and Wales.

9.7) In the event of Gear Digital operating a free to play competition, some or all of these terms and conditions will be altered and/or amended where appropriate.
